Staffan Teste, Bildombudsmannen AB, works as Picture ombudsman for Nordic countries. If you have problem to receive money from a buyer we can help you. We are involved in infringements of pictures owned by small copyright owners to big rights holders and picture agencies. As long as you own the copyright we will help you.
     Since 1977 we have helped several hundred copyright owners to receive money from a few thousand crowns to half a million. During late 90-ties we helped 18 picture agencies to receive about one million crowns from a collecting society. We help copyright owners and picture buyers to write fair contracts. We have also helped models to receive what they should and helped people, who have been unlawfully used in advertising.
     Teste is also working for BLF the Swedish organisation for photo companies and agencies in Sweden, second largest organisation of that kind in Europe and a member of Cepic.
   Staffan Teste has experience in International law in his position as a former member of the board of the European Picture agency organisation Cepic. He has represent Cepic in the World Intellectual Organisation, WIPO and in EU-hearings.
     Companies outside Sweden use Bildombudsmannen to help them with their problems in the picture world. Bildombudsmannen represent members of Picscout www.picscout.com   on Nordic countries. Staffan Teste is member of an International law discussion group in Cepic. Every year lawyers from that group meet at Cepic conference in Europe.

Foto med annans kamera?

Hej Vi har ett intressant upphovsrättsproblem. En reporter på en lokal tidning intervjuade och fotade några politiker. Vid det tillfället bad en av politikerna att reportern skulle ta en gruppbild med en av politikernas privata kamera. Det gjorde reportern och lämnade tillbaka kameran utan att närmare förhöra sig om bildens användning. Politikern kunde inget om upphovsrätt och ansåg sig kunna använda bilderna i sin kamera utan att fråga någon. Bilden kom så till en annan tidning där den användes i en annons för politikern inför valet. Bilden uppgavs komma ur politikerns egen kamera. När så reportern ser bilden som han antar att han själv tagit i konkurrenttidningen protesterar han till politikern, därefter skickar han en faktura till tidningen som oanande publicerat bilden i en annons. Nu undrar vi; Har reportern rätt till bilden? Har kameraägaren rätt till bilden? Vem är skyldig till ev intrång när bilden används i en annons? Vilken ersättningsnivå kan det i så fall vara fråga om?

Upphovsrätten tillfaller den som skapat bilden dvs. tryckt på kamerans knapp. Sedan är det i detta fall en fråga om det var en fotobeställning och parternas avsikt vid beställningen. Fotografen kan begära ersättning för fotouppdraget. men politikern kan nog hävda att avsikten var att bilden skulle kunna användas i hans egna sammanhang, porträtt etc. Fotografen kan å sin sida inte använda sig av bilden utan att ersätta för film och kamerahyra. Intressant fall. För att riktigt ta ställning behövs dock fler uppgifter om hur publiceringen såg ut m.m. Priser finns i BLF:s cirkaprislista antingen för fotouppdrag eller för annonspublicering. Ytterst är det nog bara en domstol som kan tolka hur upphovsrättslagen skall tolkas i detta fall.
