Staffan Teste, Bildombudsmannen AB, works as Picture ombudsman for Nordic countries. If you have problem to receive money from a buyer we can help you. We are involved in infringements of pictures owned by small copyright owners to big rights holders and picture agencies. As long as you own the copyright we will help you.
     Since 1977 we have helped several hundred copyright owners to receive money from a few thousand crowns to half a million. During late 90-ties we helped 18 picture agencies to receive about one million crowns from a collecting society. We help copyright owners and picture buyers to write fair contracts. We have also helped models to receive what they should and helped people, who have been unlawfully used in advertising.
     Teste is also working for BLF the Swedish organisation for photo companies and agencies in Sweden, second largest organisation of that kind in Europe and a member of Cepic.
   Staffan Teste has experience in International law in his position as a former member of the board of the European Picture agency organisation Cepic. He has represent Cepic in the World Intellectual Organisation, WIPO and in EU-hearings.
     Companies outside Sweden use Bildombudsmannen to help them with their problems in the picture world. Bildombudsmannen represent members of Picscout www.picscout.com   on Nordic countries. Staffan Teste is member of an International law discussion group in Cepic. Every year lawyers from that group meet at Cepic conference in Europe.

Tagen bild och bilder folk vill ha.

Jag är med i en teaterförening och förra sommaren höll vi på med medeltidsteater. Jag dokumenterade i vanlig ordning. Jag la upp bilderna på Facebook eftersom jag ville visa alla hur härligt vi hade det.
Nu har dock en av bilderna dykt upp i föreningens tidning. De har använt bilden utan att prata med mig. Kan de göra så? Det står inte ens att det är jag som är fotografen. Spelar det roll att chefredaktören är med i bilden de har använt?

Sen till min andra fråga. Jag fotograferade lite till en teaterföreställning i skolan där jag gick. I reklam syfte. Nu har några av skådespelarna frågat om de kan få bilderna, har jag en skyldighet att dela med mig av dem.

Nej bilder får inte användas utan tillstånd av upphovsmannen. Du kan sända en faktura för publiceringen. Det spelar ingen roll vilka som är med på bilden såvoda inte de avtalat med dig om att de skulle få använda bilden. Fotografens namn skall alltid anges i redaktionella sammanhang. Även för detta utgår ersättning, skadestånd liksom publiceringen utan tillstånd. Om inget avtal träffas om att personer som ställer upp på fotografering av dem själva skall ha ersättning i form av en bild har fotografen ingen skyldighet att dela med sig av bilderna. Sedan kan det ju vara en annan sak att fotografen ger dem en kopia, men med förbehållet att de inte får använda bilden för publicering eller tillgängliggörande på Internet.
